1. Scope
1.1 A utilization of the internet pages (hereinafter referred to as: ‘Local Tradie Website’) provided by Local Tradie is subject to these Terms of Use. These Terms of Use can in individual cases be amended, modified or replaced by other terms and conditions, e.g. for the purchasing of advertising and/or services. In the event of a conflicting situation, said other terms and conditions shall prevail over these Terms of Use.
1.2 These Terms of Use in their corresponding version are accepted by the user with the Log-in, or, in the event that a separate login is not required, by commencing with the utilization.
1.3 Local Tradie is authorized to completely or partially shut down the operation of the Local Tradie Website or to change the contents of the Local Tradie Website as it sees fit. Due to the nature of the Internet and of computer systems, Local Tradie cannot accept any liability for the uninterrupted availability of the Local Tradie Website.
2. Registration, Password
2.1 Some of the pages of the Local Tradie Website may be password-protected. Access to these pages is, based on the security of business transactions, only available for registered users. There is no right to a registration on behalf of Local Tradie. Local Tradie reserves the right to determine sites, which were previously freely accessible, to be subject to registration. Local Tradie is authorized at any given time and without obligation to give reason, to revoke access authorization data by means of blocking access data, particularly in the event that the user
- uses false data for the purpose of registration
- has violated the Terms of Use or neglects his/her duty of care in regard to his access or user data respectively
- has violated applicable law in the course of access or utilization of the Local Tradie Website or
- has not used the Local Tradie Website over a prolonged period of time.
2.2 If a registration required, then the user is under obligation to supply accurate information in the course of the registration and, in the event of possible changes over time, to immediately communicate these to Local Tradie.
2.3 The user will choose a user name and a password (hereinafter referred to as ‘User Data’) after completion of the registration process. The user data allows the user to view his/her data, to change these or, if need be, to revoke or modify approvals for the utilization of data.
2.4 The user ensures that user data is not made accessible to third parties. The area protected by a password is to be logged off from after each utilization. The user is under obligation to notify Local Tradie immediately either in written form or per Email to the extent that he/she has gained knowledge that third parties are misusing user data.
2.5 After receipt of a notification pursuant to Para. 2.4, Local Tradie will deny access to the password-protected area by means of said user data. Revoking this blockage is only possible after a separate request by the user to Local Tradie or by means of a new registration.
2.6 The user may at any given time demand termination of his registration either in writing or per Email, provided that deletion is not opposed to the carrying out of ongoing contractual relationships. Local Tradie will in this case delete all user data and all other stored person-related data of the user, as soon as these are no longer required.
3. Terms
3.1 By accessing this web site, you are agreeing to be bound by these web site Terms and Conditions of Use, all applicable laws and regulations, and agree that you are responsible for compliance with any applicable local laws. If you do not agree with any of these terms, you are prohibited from using or accessing this site. The materials contained in this web site are protected by applicable copyright and trade mark law.
4. Listings
4.1 By completing the “Create Listing” form you are accepting that upon the expiration of the 30 day guarantee the full amount of your invoice must be paid by the 20th of the following month.
4.2 The Local Tradie 30 day guarantee applies to all listings for a period of 30 days after the submission of their listing via the website “Create Listing” page. The user may remove their listing by contacting us by email within this period at which point no payment will be pursued.
4.3 By submitting a listing you are agreeing that from time to time you may receive information from Local Tradie in regard to services and special offers and to keep you informed of the running of the Local Tradie website.
4.4 You agree that all information provided to us on submission of your Local Tradie listing to be true and accurate and any industry qualifications are true and current and that any trade associations you are a member of are true and current for the duration of your listing on the Local Tradie website. If any of this information or any of these details change, you will advise Local Tradie by email as soon as possible. Local Tradie will check the tradesperson’s qualifications and information where possible but will not be held liable for any incorrect information provided by tradespeople upon submission of their listing and the information provided within.
4.5 If you feel your business has been listed incorrectly, or without your permission and would like your listing changed or removed, please contact Local Tradie and we will make the appropriate changes to your listing and/or remove any listing breaching a companies or individuals copyright or intellectual property.
5. Use License
5.1 Permission is granted to temporarily download one copy of the materials (information or software) on Local Tradie’s web site for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not:
- modify or copy the materials;
- use the materials for any commercial purpose, or for any public display (commercial or non-commercial);
- attempt to decompile or reverse engineer any software contained on Local Tradie’s web site;
- remove any copyright or other proprietary notations from the materials;
- transfer the materials to another person or “mirror” the materials on any other server.
5.2 This license shall automatically terminate if you violate any of these restrictions and may be terminated by Local Tradie at any time. Upon terminating your viewing of these materials or upon the termination of this license, you must destroy any downloaded materials in your possession whether in electronic or printed format.
6. Disclaimer
6.1 The information & materials on Local Tradie’s web site are provided “as is”. Local Tradie makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties, including without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights. Further, Local Tradie does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the businesses and tradespeople or information given by the businesses or tradespeople on its internet web site or otherwise relating to such information or on any sites linked to this site.
7. Limitations
7.1 In no event shall Local Tradie or its associates & suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption,) arising out of the use or inability to use the information on Local Tradie’s internet site, even if Local Tradie or a Local Tradie authorised representative has been notified orally or in writing of the possibility of such damage. Because some jurisdictions do not allow limitations on implied warranties, or limitations of liability for consequential or incidental damages, these limitations may not apply to you.
8. Revisions and Errata
8.1 The information appearing on Local Tradie’s web site could include technical, typographical, or photographic errors. Local Tradie does not warrant that any of the information on its web site are accurate, complete, or current. Local Tradie may make changes to the information contained on its web site at any time without notice. Local Tradie does not, however, make any commitment to update the information.
9. Links
9.1 Local Tradie has not reviewed all of the sites linked to its internet web site and is not responsible for the contents of any such linked site. The inclusion of any link does not imply endorsement by Local Tradie of the site. Use of any such linked web site is at the user’s own risk.
10. Site Terms of Use Modifications
10.1 Local Tradie may revise these terms of use for its web site at any time without notice. By using this web site you are agreeing to be bound by the then current version of these Terms and Conditions of Use.
11. Ratings & Reviews
11.1 Reviews & ratings are available for all users to submit for a limited time.
11.2 Users may comment on a particular tradie’s listing more than once, however you can only enter star ratings once per listing in order to maintain genuine and consistent ratings.
11.3 All ratings should be honest and indicative of the performance of that particular tradie. All comments and reviews are moderated and we reserve the right to exclude any comments or reviews that we believe to be spam, false, misleading and/or contain the use of offensive or threatening language. We also reserve the right to allow any negative comments or reviews in order to maintain a transparent service to our users, we will not remove negative comments and reviews upon request simply because they not positive.
12. Job Quote Request
12.1 Our job quote request service is available to all users. All tradies receiving quote requests through the use of this service are either members of credible industry trade associations or have provided us with industry qualification information relating to their trade upon submission of their listing.
12.2 Users are to use this service at their own risk and should carry out their own research and seek professional advice prior to entering into any contracts with any tradesperson as a result of using the job quote request service.
12.3 Local Tradie accepts no responsibility for any advice given, losses or damages resulting in work carried out by the tradesperson as the result of the use of the job quote request service.
12.4 All negotiations, contracts and correspondence between the user and tradesperson resulting in the use of the job quote request service are between the user and tradesperson. Local Tradie will not enter into any correspondence resulting on the use of the job quote request service.
13. Governing Law
13.1 Any claim relating to Local Tradie’s web site shall be governed by the laws of New Zealand.
